Overview

Sarah Zgliniec is a litigator, focusing in complex commercial litigation, arbitration, and intellectual property litigation. Her practice is diverse, including commercial disputes, international arbitration, false advertising and trademark litigation, law firm defense, and other commercial matters.  Before joining the firm in 1998, Ms. Zgliniec served as Law Clerk to the Hon. Reena Raggi, U.S. District Court, Eastern District of New York.

Representative Matters

Complex Commercial Litigation and Appeals

Represent clients in consumer products, pharmaceutical, banking, and media industries in commercial litigation and arbitration.

Appellate counsel in numerous appeals before the Second and Ninth Circuits, the New York State Court Appellate Divisions, and the New York State Court of Appeals.

Recent matters include breach of contract, partnership, and eminent domain issues, as well as issues under the False Claims Act, the False Patent Marking Act, the Alien Tort Statute, and New York State's Workers' Compensation Law.

International Commercial Arbitration

Represent clients from Canada, Mexico, and Australia in contractual disputes before the American Arbitration Association, JAMS, and London Court of Arbitration. 

Member of Arbitration Rules Committee of the International Institute for Conflict Prevention and Resolution (CPR).

Legal Ethics and Law Firm Defense

Represented major international law firm in two actions to disqualify the firm from representations on the basis of conflicts of interest.

Represented major national law firm in dispute brought by headhunter with respect to fees in connection with the firm’s combination with another law firm.

Represented major national law firm in a compensation dispute with one of its partners.

Member of the Department Disciplinary Committee of Appellate Division of the First Judicial Department of the State of New York; member of New York State Bar Association Committee on Professional Discipline.

False Advertising and Trademark Litigation

Represent clients in consumer products and media industries in false advertising actions against competitors. 

Prosecution and defense of trademark actions on behalf of toy, pharmaceutical, and media companies. 

Libel and Defamation Litigation

Obtained dismissal of spurious defamation claim against law firm for statements it made in the course of representing its client.

Defended publisher of medical journal that ran an AIDS drug advertisement featuring the allegedly unauthorized photograph of the plaintiff.

Defended network radio station and its morning "shock jock" in a defamation action brought by the alleged "Olympic Park bomber."
