Firm Files Amicus Brief on Behalf of an Interfaith Coalition in Supreme Court Border Wall Case
On Tuesday, January 19, the Firm proudly filed an amicus brief on behalf of 87 religious and religiously-affiliated organizations across the country in Trump v. Sierra Club. In this case, currently pending before the Supreme Court, the Sierra Club, the Southern Border Community Coalition, and the States of California and New Mexico challenged the Trump Administration’s attempt to misappropriate otherwise-allocated funds for construction of a southern border wall. The Firm’s brief argued that the Trump Administration’s actions violated the constitutional separation of powers and the Appropriations Clause of the U.S. Constitution. As potentially and historically disfavored religious groups, amici pointed to the particular risk they face from an unchecked executive branch as reason to protect Congress’s power of the purse.
On his first day in office, President Biden signed an executive order terminating the “national emergency” at the southern border, pausing work on the wall to the extent permitted by law, and ordering an assessment of current plans and contracts. This Order may resolve the case.
