Erik Haas is a member of the Firm's Litigation department and Co-Chair of the Firm's Structured Finance Litigation team and its False Claims Act and Whistleblower Defense team. Mr. Haas’s practice encompasses a wide range of complex commercial litigation, including the following substantive areas: (i) structured finance and securitizations, (ii) whistleblower actions under the False Claims Act, the Sarbanes-Oxley Act, the Dodd-Frank Act, and state and federal employment statutes, (iii) international joint venture disputes, (iv) intellectual property litigation, and (v) shareholder class and derivative actions. Mr. Haas joined the Firm in 1993 upon his graduation from New York University School of Law where he was presented with American Jurisprudence Awards. Before attending law school, he spent three years with Arthur Andersen & Company, where he focused on structured finance and securitization transactions, and secured his CPA license.
Mr. Haas is recognized by Chambers USA in the area of Litigation: Securities. The guide notes that he received “strong praise for his ‘good courtroom manner and terrific client service.’" Chambers also quotes a client who comments that Mr. Haas "is very client-friendly, and is always willing to take the extra step to work with you and take your thoughts into account." Another client highlighted his "very creative approach, and excellent command of the law." Represents major domestic and foreign clients in high-stakes and complex commercial disputes, involving a broad range of substantive matters, from international joint venture disputes to common law fraud claims.
Complex Structured Finance Litigation
Represents financial guarantors and private investment firms in matters against sponsors, originators and servicers of mortgage-backed securities, collateralized debt obligations, and net interest margin securities. Represents sponsor in commercial mortgage-backed securities transactions. Represents foreign corporations in complex derivative disputes with domestic investment banks.
Pricing and Reimbursement Fraud
Represents major institutions in connection with investigations and litigations brought under unfair and deceptive act statutes arising from allegations of pricing and reimbursement fraud.
Whistleblower Litigation and Investigations
Defending companies against whistleblower allegations advanced under False Claims Act, Sarbanes-Oxley, Dodd-Frank and state and federal employment statutes.
Intellectual Property Litigation
Represents health care companies in defense of false advertising, misappropriation and related unfair competition claims under state and federal laws. Prevailed on behalf of an international conglomerate in a complex trade name, domain name and trade secret misappropriation action. Represents private equity firm in dispute involving domain names and trademark rights. Represented consumer product companies in false advertising, trademark, trade actions brought in federal and state courts. Represented the Federal Deposit Insurance Corporation in its successful suits against banks and credit card companies involved in deceptive credit card offerings.
Shareholder Class and Shareholder Derivative Actions
Defending the Board of Directors of a major corporation in shareholder derivative and class action actions brought in state and federal court.
