Erik Haas is a member of the firm's litigation department and Co-Chair of the firm's Structured Finance Litigation Team and its False Claims Act and Whistleblower Defense Team. Mr. Haas’s practice encompasses a wide range of complex commercial litigation, including the following substantive areas: (i) structured finance and securitizations, (ii) whistleblower actions under the False Claims Act, the Sarbanes-Oxley Act, the Dodd-Frank Act, and state and federal employment statutes, (iii) shareholder class and derivative actions, (iv) international joint venture disputes, and (v) intellectual property litigation. Mr. Haas joined the firm in 1993 upon his graduation from New York University School of Law where he was presented with American Jurisprudence Awards. Before attending law school, he spent three years with Arthur Andersen & Company, where he focused on structured finance and securitization transactions, and secured his CPA license.
Mr. Haas is recognized by Chambers USA in the area of Litigation: Securities. The guide notes that he received “strong praise for his ‘good courtroom manner and terrific client service.’" Chambers also quotes a client who comments that Mr. Haas "is very client-friendly, and is always willing to take the extra step to work with you and take your thoughts into account." Another client highlighted his "very creative approach, and excellent command of the law." Represents financial guarantors and private equity firms in matters against sponsors, originators and servicers of mortgage-backed securities, collateralized debt obligations, and net interest margin securities. Represents foreign corporations in complex derivative disputes with domestic investment banks.
Shareholder Class and Shareholder Derivative Actions
Defending the Board of Directors of a major corporation in shareholder derivative and class action actions brought in state and federal court.
Pricing and Reimbursement Fraud and False Claims Act Matters
Represents major institutions in connection with investigations and litigations brought under unfair and deceptive act statutes and the False Claims Act arising from allegations of pricing and reimbursement fraud.
Employment Whistleblower Litigation and Investigations
Defense of corporations against whistleblower allegations under Sarbanes-Oxley, Dodd-Frank and state and federal employment statutes.
Recently secured a $200 million settlement in an antitrust litigation brought by large pharmaceutical client.
Intellectual Property Litigation
Represents private equity firm in dispute involving domain names and trademark rights. Represented consumer product companies in false advertising, trademark, trade actions brought in federal and state courts. Also recently represented the Federal Deposit Insurance Corporation in its successful suits against banks and credit card companies involved in deceptive credit card offerings.
