NYC "Ban the Box” Legislation – Implications for Hiring Practices
On October 27, 2015, the New York City Fair Chance Act (the “Act”) went into effect. In passing the Act, New York City joined a growing number of cities and states that passed “ban the box” legislation. Under the Act, employers are not permitted to ask job applicants about their criminal history before extending a conditional offer of employment. The Act also contains other regulations that affect the job application process. Employers located in New York City should review the new law and make sure that their job application procedures are in compliance.
