Biography

Jonah M. Knobler practices in the Firm’s Litigation department. His practice currently focuses on class-action defense and false-advertising litigation on behalf of corporate clients, principally in the food-and-drug and consumer-product industries. He also has experience litigating copyright and trademark disputes, defending civil RICO claims, and handling critical appeals. Mr. Knobler has represented clients at all levels of the federal and state judicial systems, from the trial courts to the United States and state Supreme Courts.

Recently, Mr. Knobler was named to the National LGBT Bar Association’s 2018 “Best LGBT Lawyers Under 40,” which recognizes 40 LGBT legal professionals “who have distinguished themselves in their field and have demonstrated a profound commitment to LGBT equality.” He was also named to Benchmark Litigation’s 2017 “Under 40 Hotlist,” which recognizes “practitioners, all aged 40 or younger, [who] have been deemed the most promising emerging talent in their respective litigation communities … by peers and clients.”

From 2009 to 2010, Mr. Knobler served as a Law Clerk to the Hon. Danny J. Boggs of the U.S. Court of Appeals for the Sixth Circuit. From 2008 to 2009, Mr. Knobler served as a Law Clerk to the Hon. Frederic Block of the U.S. District Court for the Eastern District of New York.

Representative Matters

Food, Drug, Cosmetic, and Dietary Supplement Litigation

  • Currently representing a leading beverage manufacturer in false-advertising litigation regarding allegedly false health claims and alleged suppression of health information.

  • Prevailed at the district-court and appellate levels in a civil RICO suit brought against a major pharmaceutical manufacturer alleging off-label marketing of a prescription medicine.

  • Obtained partial reversal on appeal of a nationwide injunction prohibiting the sale of a client’s flagship cosmetic product, allowing client to sell the product in 49 states rather than zero states.

  • Defeated certification of nationwide and statewide classes in a lawsuit alleging mislabeling and false advertising of a leading vitamin supplement.

  • Obtained dismissal of a consumer-protection class action against a major food company alleging failure to disclose improper labor practices in the client’s indirect supply chain; currently defending the dismissal on appeal.

  • Defended a leading pet-food manufacturer against Lanham Act false-advertising claims brought by a competitor, while prosecuting false-advertising counterclaims against that competitor; helped obtain a favorable settlement.

  • Represented a major dietary-supplement manufacturer in Lanham Act litigation against parties who counterfeited the client’s product and wholesalers and retailers who trafficked in the counterfeits, obtaining favorable settlements and a $20 million judgment against the non-settling defendants.

  • Successfully opposed the creation of a multi-district litigation and defeated two class-certification motions in nationwide litigation involving an infant-formula recall; obtained dismissal of numerous copycat class-action complaints prior to certification phase.

  • Successfully defended on appeal a favorable classwide settlement of false-advertising and consumer-protection claims brought against a major pet-food manufacturer.

  • Obtained favorable pre-certification resolution of class-action complaints involving “natural” claims, nutrient-content claims, non-functional “slack fill,” and other asserted instances of mislabeling and misbranding.

  • Represented a major pharmaceutical company before a state’s supreme court in a certified-question case involving a novel issue of state products-liability law.

  • Successfully defended a major pharmaceutical company in a lawsuit alleging that the client’s medicine caused homicidal conduct; obtained dismissal with prejudice of all claims.

Intellectual Property and Media Litigation

  • Represented a major dietary-supplement manufacturer in Lanham Act litigation against parties who counterfeited the client’s product and wholesalers and retailers who trafficked in the counterfeits, obtaining favorable settlements and a $20 million judgment against the non-settling defendants.

  • Representing a television station in litigation against the City of New York and the NYPD seeking access to police body-camera footage under the New York Freedom of Information Law.

  • Represented a major electronics manufacturer in the appeal of an adverse attorney-fee award in a trademark-infringement case.

  • Obtained a multi-million-dollar judgment on behalf of a leading media company against a competitor for republishing the client’s time-sensitive financial analyses.

  • Obtained a multi-million-dollar settlement on behalf of a leading media company in a dispute involving online copyright infringement.

  • Represented an award-winning photographer seeking to halt unauthorized use of his work on the Web, Facebook, and Twitter.

Pro Bono Advocacy

  • Currently representing a nonprofit, a state political party, and 15 voters in a high-profile lawsuit challenging North Carolina’s Congressional map as an unconstitutional partisan gerrymander; obtained a favorable judgment and awaiting U.S. Supreme Court review.

  • Drafted and filed amicus briefs in the U.S. Supreme Court on behalf of nonprofits, individuals, and political parties in major cases including Obergefell v. Hodges (marriage equality); Gloucester County School Board v. G.G. (transgender rights); Gill v. Whitford (partisan gerrymandering); and Evenwel v. Abbott (one-person-one-vote).

  • Defended an HIV+ woman from a defamation suit brought against her for making an HIV-discrimination claim.

  • Represented national and state disability-rights groups as amici curiae in a disability-discrimination appeal before the Second Circuit.

  • Represented the Manhattan District Attorney’s Office, obtaining affirmance of a criminal conviction.
