Firm Prevails in Suit Against Presidential Advisory Committee on Election Integrity; Key Documents Released
Together with American Oversight, Patterson Belknap secured a significant victory for Maine Secretary of State Matt Dunlap, a member of the now-disbanded Presidential Advisory Commission on Election Integrity (the “Commission”) in an ongoing lawsuit to obtain documents from the Commission. In December 2017, a federal judge ruled that Secretary Dunlap cannot be excluded from participating in the work of the Committee on which he served as a member and ordered the Commission to provide him with copies of Commission documents. Less than two weeks after the ruling, President Trump disbanded the Commission, rather than comply with the Court’s order.
In June 2018, the Court ruled that the Commission’s termination did not extinguish Secretary Dunlap’s right to the Commission documents and ordered the Commission to disclose the documents that Secretary Dunlap was seeking by July 18, 2018. On August 3, 2018, Secretary Dunlap released the documents publicly and announced his preliminary review of those documents, stating that “they do not contain evidence of widespread voter fraud.”
