Firm Secures Dismissal of Contract Claims in Class Action Suit on Digital Royalties

On January 11, 2022, the Firm secured dismissal of breach of contract claims in a putative class action filed by a proposed class of textbook authors against our client, a major educational publisher and technology firm, in New York federal court alleging that our client denied the textbook authors royalties from digital sales.  Our team obtained a significant victory when Judge Lorna G. Schofield of the U.S. District Court for the Southern District of New York agreed with our client that the plaintiffs’ breach-of-contract claims seeking royalties from all digital products should be dismissed. The court held that the authors’ royalty contracts entitled them to the net receipts from just the textbooks and ebooks and that the authors are not entitled to royalties for additional content.
