Firm Secures Settlement and Permanent Injunction in Counterfeit Suit on Behalf of a Medical Device Manufacturer

On Friday, February 5, the Firm secured a settlement for our client, a Multinational Healthcare Company, when a federal judge in the U.S. District Court for the Northern District of Illinois dismissed a suit from our client against the defendant, after a consent judgment and permanent injunction was filed. The original suit accused the defendant and several employees of importing and selling dangerous and contaminated counterfeit versions of our client’s medical devices. In October 2020, the court preliminarily enjoined the defendant from buying or selling any of our client’s medical devices, whether counterfeit or authentic. 

As a result of the consent judgment and permanent injunction, in addition to a confidential monetary component, the defendant is permanently barred from buying, selling, or distributing any products made or marketed by our client. The consent judgment also provides for our client to destroy over one million authentic and suspect medical devices seized from the defendants that are worth more than $25 million.
