Firm Wins Dismissal in Products Liability Case for Healthcare Company
On July 27, 2018, the Firm scored a win for our client, a Fortune 100 healthcare company, when the court granted a motion to dismiss for lack of personal jurisdiction in a products liability suit related to talcum powder. The New York Supreme Court in Manhattan relied on the U.S. Supreme Court’s opinion in Bristol-Myers Squibb Co v. Superior Court of California, San Francisco, 136 S. Ct. 1773 and held that our client (a New Jersey company) could not be subject to jurisdiction in New York for the Virginia plaintiff’s claims arising from her alleged use of our client’s talcum powder in Virginia, despite the fact that our client was alleged to have numerous other connections to New York. This is one of the first times a New York court has reached this outcome since Bristol-Myers was decided.
