Firm Wins False Advertising Case for Allbirds
Patterson Belknap achieved a victory on behalf of Allbirds, Inc. in a putative consumer class action challenging the advertising of wool shoes. The plaintiff alleged that Allbirds misrepresents its standards for sustainability and animal welfare, and our team moved to dismiss the complaint on the grounds that the company’s statements are truthful and not misleading to reasonable consumers. On April 18, 2022, Judge Cathy Seibel of the U.S. District Court for the Southern District of New York granted our motion in full, finding that Allbirds’ “statements, advertisements, and practices . . . are not materially misleading” as a matter of law. The Court also refused to allow further amendment of the complaint, making the dismissal with prejudice.
