Federal Circuit Affirms Attorneys’ Fees Award in Stent Patent Suit

Law360, New York (January 03, 2012) -- The Federal Circuit on Tuesday upheld a lower court’s decision ordering medical device maker MarcTec LLC to pay $4.7 million in legal fees to Cordis Corp., ruling that the district court correctly determined that the suit over stent patents was brought in bad faith.

The appeals court affirmed an Illinois federal judge’s 2010 ruling that found that MarcTec's case against the Johnson & Johnson subsidiary was frivolous and relied on mischaracterizations of the claim construction adopted by the court and expert testimony that didn’t hold up to requirements of scientific reliability or relevance.
