Firm Defeats Motion to Dismiss for Client Alleging Theft of Information from Its Proprietary Real Estate Database

On July 25, 2018, the New York Supreme Court denied a motion to dismiss in favor of our client, a real estate information company. Our client filed a complaint against ATCO, a commercial real estate operating company, alleging fraud and breach of contract for unauthorized usage of our client’s proprietary database. In the decision, the court denied ATCO’s motion to dismiss in its entirety, and agreed that ATCO’s alleged conduct “makes out the necessary egregious conduct necessary to sustain a claim for punitive damages at this stage of the pleadings.”
