Firm Secures Dismissal of Product Liability Lawsuit on Behalf of Pharmaceutical Company

On July 19, 2022, the New York State Appellate Division, First Department, ruled in favor of our client, a Fortune 100 pharmaceutical and consumer goods company, reversing a $325 million dollar jury award and dismissing a product liability case relating to cosmetic talcum powder.  Specifically, the Court found that Plaintiff’s medical expert failed to set forth any scientific expression of asbestos exposure caused by our client’s cosmetic talcum powder that would be sufficient to cause Plaintiff’s illness.  The decision marks the first major ruling from a New York Appellate Court applying recently clarified standards for proof of causation in asbestos cases.
