Firm Secures Second Preliminary Injunction For Healthcare Client Against “Gray Market” Distributors

On December 23, 2015, Judge Amon, Chief United States District Judge of the U.S. District Court for the Eastern District of New York, preliminarily enjoined 19 distributors and one pharmacy from selling a global healthcare company’s blood glucose test strips in international packaging. The court found that these diverted test strips "satisfy the low threshold of materiality that separates genuine from non-genuine gray goods." The decision follows a November 6, 2015 preliminary injunction the firm won on behalf of the same client against multiple distributors, barring them from re-importing and selling the company’s blood glucose test strips on the “gray market.”
