Firm Wins Dismissal in Patent Litigation for Sony Electronics
On February 8, 2019, the Firm won a significant victory when the U.S. District Court for the District of Delaware dismissed a claim for patent infringement by plaintiff Location Based Services against our client Sony Electronics Inc. In its amended complaint, Location Based Services asserted infringement of claim 6 of U.S. Patent No. 8,311,733, entitled “Interactive Key Frame Image Mapping System and Method.” Sony moved to dismiss under Rule 12(b)(6) for failure to state a claim. At oral argument on Sony’s motion, heard by both Judge Stark and Magistrate Judge Burke, the Delaware district court agreed with Sony that asserted claim 6 was directed to the abstract idea of collection, organization, manipulation, and display of data, and that the claim lacked an inventive concept. Judge Stark proceeded to rule from the bench that claim 6 was directed to unpatentable subject matter under Section 101 of the Patent Act and granted Sony’s motion to dismiss with prejudice.
