Firm Wins Significant Victory for McGraw Hill Financial, Inc.

The firm won a significant victory for McGraw Hill Financial, Inc. in a nearly five year old litigation brought in federal court in New York by Reed Elsevier. Reed brought the case in 2009, alleging violations of the RICO Act, the Sherman Act, the Lanham Act, and myriad state law claims as a result of McGraw Hill’s construction division’s alleged improper access to its competitor Reed’s database for construction project information. In 2010, the Court dismissed Reed’s RICO claims. On September 24, the Court dismissed all but one of Reed’s remaining claims, leaving only a limited version of its unfair competition claim. Separately, following a two-day hearing, the court excluded Reed’s damages expert.
