Firm’s Win for Pharmaceutical Company Affirmed on Appeal

On September 27, 2019, the Firm scored a significant victory when the Alabama Supreme Court affirmed an April 24, 2018 Monroe Circuit Court decision in favor of our client in connection with the product liability defense of a biologic medication, finding that the Plaintiffs’ claims were time-barred.  The Supreme Court upheld the lower court’s ruling striking the Plaintiffs’ original unsigned pleading and dismissing claims asserted in an amended complaint that were filed after the statute of limitations had expired.
