Sarah Zgliniec is a partner in the firm’s litigation department, with a practice focusing on sophisticated commercial disputes.  She represents clients in a wide variety of cases, including complex commercial matters, false advertising cases, trademark claims, consumer class actions, contract disputes, and others.  Her clients include major food and beverage companies, packaged goods manufacturers, pharmaceutical companies, and financial institutions.  In addition to practicing in the federal and state courts, Ms. Zgliniec also represents clients in arbitrations before the AAA/ICDR, JAMS, and the London Court of Arbitration.  She has also served as appellate counsel in numerous appeals before the Second and Ninth Circuits, the New York State Court of Appeals, and the New York Appellate Divisions. 

Ms. Zgliniec is a Certified Information Privacy Professional (CIPP/US) through the International Association of Privacy Professionals.

Ms. Zgliniec graduated from Dartmouth College, Phi Beta Kappa, and received her law degree from New York University School of Law, where she was elected to the Order of the Coif.  Before joining the firm, Ms. Zgliniec served as Law Clerk to the Hon. Reena Raggi, U.S. District Court for the Eastern District of New York.

Representative Matters

False Advertising and Unfair Competition
Secured a federal jury verdict for the world’s leading beverage company in a landmark advertising dispute over juice labeling.  The U.S. Supreme Court had remanded the case for trial in 2014, holding that FDA regulations authorizing our client’s label did not bar the plaintiff’s suit.  In 2016, a California federal jury returned a verdict in our client’s favor after a six-day trial and less than a day of deliberation.

Represented the world’s leading beverage company in a multidistrict litigation consisting of eight putative consumer class actions.  In each action, the plaintiffs allege that our client’s signature soft drink is misbranded in violation of FDA regulations and state law. 

Defended the world’s leading beverage company’s advertising for premier sports drink against claims brought by manufacturer of rival sports drink.

Represented cable-TV provider in a suit challenging satellite-TV provider’s claim to offer more HDTV channels than cable.

Defended manufacturer of household all-purpose spray cleaner in a false advertising suit brought by competitor.

Advises major pharmaceutical manufacturer about potential challenges to false advertising claims by competitor.

Counsels clients concerning trademark infringement and clearance matters.

Handled cease-and-desist work concerning flagship marks for clients including a major toy maker and a pharmaceutical company.

Litigates trademark office actions and oppositions before the TTAB.

Handles ICANN proceedings regarding infringing domain name registrations.

Advises major pharmaceutical manufacturer about potential challenges to false advertising claims by competitor.

Represented major pharmaceutical company in a series of disputes against rival drug company concerning a product license agreement that split the parties’ rights to each sell the same drug for different indications.

Represented major pharmaceutical company in antitrust challenge against competitor that incentivized customers to purchase bundled drugs by offering discounts on a monopoly drug.

Represented major pharmaceutical company in purported ERISA class action case alleging that client’s form severance agreement guaranteed employees payments from more than one severance plan.

Represented major pharmaceutical company concerning FTC’s inquiry into safety of over-the-counter pain reliever.

Financial Services
Represented major U.S. banking institution in responding to subpoenas from Fair Housing Finance Agency (FHFA) pertaining to residential mortgage-backed securities purchased by Fannie Mae and Freddie Mac, and successfully negotiated with FHFA not to sue our client.

Represented major U.S. banking institution in antitrust litigation brought by payment card company relating to credit card issuing rules.
