Counterfeiter of 5-Hour Energy Receives Prison Sentence
On April 26, 2017, U.S. District Judge Lucy Koh sentenced Walid Jamil, owner of Midwest Wholesale Distributors, to seven years in prison and three years of supervised release for his role in counterfeiting 5-Hour Energy. He is the first to be sentenced from the large counterfeiting ring that was producing and selling fake drinks in 2011 and 2012. Seven other defendants who are criminally charged are awaiting sentencing.
This is the first criminal prosecution of a counterfeiting operation involving food or beverages. The U.S. Attorney’s Office relied heavily on the foundation that Partner Geoffrey Potter and a team of Patterson Belknap attorneys laid in a civil action on behalf of 5-Hour Energy that resulted in a judgment of more than $20 million in April 2016.
