Firm Secures Dismissal of Claims Against Client in Proposed Class Action
On April 18, 2019, the Firm scored a significant victory when the U.S. District Court for the Southern District of New York dismissed all claims filed against our client, a former independent director of a major film company, in a putative class action against a film producer and related production companies and executives. Plaintiffs brought claims under the Racketeer Influenced and Corrupt Organizations Act (“RICO”), but Judge Alvin K. Hellerstein granted Defendants’ motion to dismiss, ruling that Plaintiffs failed to allege a cognizable RICO claim against the film companies, executives, and directors. Judge Hellerstein also dismissed seven state law claims including negligent supervision, assault, civil battery, false imprisonment, intentional infliction of emotional distress, negligent infliction of emotional distress, and ratification.
