Firm Secures Significant Victory for Johnson & Johnson Subsidiaries in Medical Device Patent Litigation

On April 11, 2025, Patterson Belknap secured a significant victory for our clients, Johnson & Johnson subsidiaries DePuy Synthes, Inc., Synthes USA, LLC, Synthes USA Products, LLC, and DePuy Synthes Sales, Inc., in a medical device patent infringement litigation concerning DePuy Synthes’ TFN-ADVANCED™ Proximal Femoral Nailing (“TFNA”) system. The TFNA system is the leading hip fracture repair system in the United States and has been used by orthopedic surgeons to treat hundreds of thousands of patients in the U.S. and abroad.

The U.S. District Court for the District of Delaware granted DePuy Synthes’ fully dispositive motion for summary judgment of invalidity for lack of enablement, finding all fifteen asserted claims (across two patents) invalid. As a result, the Court cancelled the upcoming trial scheduled to begin April 28, 2025. The plaintiff, Spinal Generations, LLC, had initially asserted three additional patents in the case, but withdrew its claims of infringement for each during the course of discovery. The plaintiff was seeking substantial damages on sales of DePuy Synthes’ TFNA system, which was launched in October 2017.
